The Trump Crime Family Under Scrutiny

The Trump Crime Family Under Scrutiny

91 indictments should be enough to stop Trump's re-election, but so far the leader of the Trump Crime Family seems to feel political push back

OPINION:

The Scandal of the Trump Crime Family

The X-Prez has been the head of a crime family operating in full view and in defiance of law enforcement for decades. Time for the Trump Crime Family to be brought to justice. Let’s start with a Senate Investigative Committee; then we can have dueling congressional hearings. Way past time to ask tough questions about Ivanka’s patent hanky-panky in China, the Trump DC hotel, and Saudi Arabia’s billions warming Jared Kushner’s wallet.

News Alert

Attention! For those in the country that haven’t gotten the news: Trump was voted out of office. Joe Biden kicked his fat, orange, ass. Trump lost by nearly 8 million votes. Period. Dot.

Disqualified

If Trump is allowed to appear on the ballot and potentially gain a second presidential term it will encourage him and others to continue their attack on our democracy, most likely ending the American experiment. Trump has declared repeatedly he will suspend the U. S. Constitution, he has also suggested women should face criminal charges for obtaining an abortion, and his threats to jail his “enemies” is chilling. The unhinged threats of the head of the Trump Crime Family cannot be ignored. The weaponization of the IRS and the DOJ will allow Trump to destroy the lives of anyone he choses. That’s ‘effin scary. Think about what Trump has said about judges, prosecutors, war heroes, and average citizens; seriously endangering the lives of those he targets. WTF? Since when is it okay for a man with the presidential bully pulpit to attack election workers? It’s clear. Trump’s concept of the presidency is similar to the North Korea model.

91 Felony Charges, to date

Holy shit. Trump is the first president of the United States, in 234 years, to be criminally indicted. 34 felony counts in New York, over allegations that he falsified business records to conceal hush money payments to Stormy Daniels, a porn star. 40 felony counts in Florida for hoarding classified documents and obstructing government efforts to collect them. 4 felony counts in D.C. related to his alleged efforts to overturn the 2020 election. In Georgia, the Fulton County DA has indicted Trump on 13 counts of election interference in that state. These are criminal charges, Trump is also facing multiple civil lawsuits. My goodness, folks, Trump is a walking crime wave. He is totally unfit for office and a group of people are trying to keep this lawless king pin off the ballot.

Groups in Multiple States

Groups in multiple states, both Republican and Democrat, are making efforts to block the twice impeached former president from running for office ever again. The basis of the strategy is to use Section 3 of the 14th Amendment to prevent Trump from running for office. The 14th Amendment is post civil war legislation intended to deal with insurrectionists in the aftermath of the Civil War. Insurrectionists and anyone who had given aid and comfort to insurgents were legally barred from running for office.   How fitting for this Twenty-First century insurrectionist.

Conclusion

Stopping Trump should be the major job  of every democracy loving American. We don’t need an indicted criminal running 0ur government for his personal and family profit. No to Trump. No to MAGA. Save Democracy, vote blue, vote Joe Biden and Kamala Harris 2024.

Trump Stuck in the Mud

By D.S. Mitchell

A Real Train Wreck

Anyone that knows me knows my total disgust of anything and everything, Trump. So, some may wonder why I would waste an hour watching the CNN Donald Trump Town Hall last night.  Frankly, I just wanted to confirm that all the character traits that originally made me loath the man were still applicable. I didn’t need the hour to confirm my original assessment, but I hung around, just because as with all train wrecks it’s hard to look away.

Friendly Audience

He had a handpicked pro-Trump audience in New Hampshire. The crowd laughed and cheered at his attacks on E. Jean Carroll who had just the day before, won a $5 million lawsuit against the ex-president for sexual assault and defamation. Hopefully, Ms. Carroll isn’t done yet because this guy hasn’t learned anything about defamation. I believe she has grounds for a second defamation case against the disgraced, twice impeached, pro-sexual assault, ex- president.

A Vivid Reminder

If nothing else, last night gave us a vivid reminder of what another term of a Donald Trump presidency would look like. I don’t know about anyone else but I’m way, way, past the chaos, shame, hatred, cruelty, lies, corruption, and total dysfunction this man brought to the White House. I’m ready to see this aberration gone into the dark night, never to be seen or heard from again.

OPINION: Republicans Fear Merrick Garland

OPINION: Republicans Fear Garland

OPINION: Republicans Fear Garland

By Wes & Anna Hessel

Champion of Justice

U.S. Attorney General Merrick Garland is again seeking to bring justice to our nation, this time  by facilitating the FBI search and seizure of alleged classified documents from Donald Trump’s Mar-A-Lago residence. Much to the chagrin of Republican party, the files were said to have been taken from the White House upon Trump’s departure.

Justice Delayed

Mr. Garland, a Chicago native and Harvard graduate, should be an associate justice of the Supreme Court, but the obstructionist right-wing GOP controlled Senate, lead by Mitch McConnell, in March 2016 refused to even take up the then Chief Judge of the United States Court of Appeals for the District of Columbia Circuit’s nomination by President Obama.  This maneuver continued on until the nomination expired in January 2017, leading to the Republicans seizing the spot vacated by the late Justice Scalia to be filled by their extremist nominee Neil Gorsuch.

Obstruction of Justice

The Republican Party have now made Attorney General Garland their newest Public Enemy Number One, demanding his immediate resignation.  The GOP insists that they will investigate Merrick should they regain their control of Congress.  We must strenuously prevent this miscarriage of justice from occurring.  Mr. Garland, with his consistent record of protecting our nation and democracy, in no way deserves this treatment.

Capitol Crimes

Donald Trump’s involvement in the January 6th insurrection is chilling, at best.  Barring the very justified actions of the Justice Department would serve to let Trump quite literally get away with murder.   “The Donald”’s blatant refusal to intervene in the invasion of the U.S. Capitol makes him culpable for the deaths of those who lost their lives as a result of this heinous violent attempt to stop the peaceful Constitutional transfer of power to the rightfully elected Joseph Biden.

Pursuit of Justice

Attorney General Garland’s heroic efforts include adroitly standing up to a slew of Republican attacks.  He has masterfully led the investigation of Mr. Trump’s lies and crimes, with a courageous pursuit of truth regarding this vile attack on our democracy.  Merrick is quoted as saying, “We intend to hold everyone, anyone, who was criminally responsible for the events surrounding January 6th…accountable.”  We must support our Attorney General Merrick Garland in the prosecution of “45”, so that Trump will be banned from ever holding or even running for public office again.

No Just Cause

“The Donald”’s and his allies’ attempts to overturn the 2020 election must not remain unpunished.  As Mr. Garland fearlessly pilots the Justice Department’s examination of Trump’s involvement in the riot, the Republican Party is making every effort to halt this investigation.  Marjorie Taylor Greene has gone so far as to file articles of impeachment against our Attorney General.

Buy The Lie

Mr. Garland has stated that he, “personally approved”, searching Trump’s home in Mar-A-Lago.  There were 147 GOP members who voted to try to overturn the legal election results of 2020, including Ms. Taylor Greene, Ted Cruz, and Josh Hawley.  Apparently they buy into the lie that the election results were “stolen”, when in fact President Joe Biden had received the most certified votes of any presidential candidate in history.

Justice Served

And Merrick Garland has strongly demonstrated his lifelong quest for justice, beginning his illustrious career as a federal prosecutor in 1989.  His first prominent action was as one of the trio of the lead prosecution for the cocaine possession case of former Washington D.C. Mayor Marion Barry.  As Deputy Assistant Attorney General during President Clinton’s term, Mr. Garland oversaw the prosecution of such critical cases as the bombings in Atlanta during the Olympics and the “Unabomber” Ted Kaczynski.

Boots On The Ground

He began leading the prosecution of the horrific truck bomb attack on the Murrah Federal Building in Oklahoma City in person on-site, and was the federal government’s primary attorney during the preliminary hearings for the two main co-conspirators, Terry Nichols and Timothy McVeigh.  Deputy Assistant Attorney General Garland was then integral in the selection of the team for their trial, and even garnered accolades from then-Governor of Oklahoma, Frank Keating, a Republican.

“Well-Qualified” Jurist

In September of 1995, President Clinton nominated Merrick for the eleventh seat on the U.S. Court of Appeals for the District of Columbia.  Republicans in the Senate refused to bring his nomination to vote over an argument of whether that seat needed to be filled in the D.C. federal circuit, despite a highest possible “well-qualified” rating of Mr. Garland by the Standing Committee on the Federal Judiciary of the American Bar Association.

Try, Try Again…

When Clinton was reelected, he renewed Merrick’s nomination in January 1997.  On March 19th when it was put to a vote, Mr. Garland was confirmed with the significant margin of 76-23, even with continued Republican Senate control.  The GOP Senators primarily voted for confirmation, amongst them Jim Inhofe, Susan Collins, Orrin Hatch, and John McCain.  His opponents were all Republican, with the likes of Jeff Sessions, Chuck Grassley, and Mitch McConnell.  He was elevated to Chief Judge of the district in February of 2013.

Stand Up And Be Counted

It is imperative that Attorney General Merrick Garland receives the support of the American people in his relentless pursuit to bring Donald Trump to justice.  The Editorial Board of the New York Times has called on Mr. Garland to prosecute Trump if there is “sufficient evidence”.  That there is such evidence is obvious, so we need to stand with the Times board and our U.S. Attorney General in pursuing Trump for his crimes.

Trump Continues Contemptuous Behavior

The Contemptuous Donald Is Finally In Contempt…

Trump faces numerous law suits around the country

By Anna Hessel with Wes Hessel

Holding The Contemptuous One in Contempt

After years of apparent criminal and questionable civil business activities, Donald Trump is finally being forced to face the music.  He is being held in contempt of court by New York State Justice Arthur Engoron.  I heartily applaud this decision and am planning a “Contempt for Trump” party, complete with champagne, a DJ for dancing, and swag bags, including a mini-Donald Trump collector’s edition dartboard, macaroons, and a bottle of Evian water, for my guests.  It’s about time the orange haired scowling monster is called on the carpet legally.  Per the citation, this civil contempt charge will cost Trump ten thousand dollars per day until such time as he turns over the subpoenaed documents.

So, What Does That Mean, Really?

So, what exactly is “contempt of court”?  We sometimes hear this phrase referenced as just “contempt”.  According to Wikipedia, being in contempt of court means, “the offense of being disobedient to or disrespectful toward a court of law and its officers.”  This can include willful disobedience of a court order, ignoring the court’s decorum or authorization, or failure to preserve a reverent frame of mind.  Investopedia defines, “Contempt of court is a legal violation committed by an individual who disobeys a judge or otherwise disrupts the legal process in the courtroom.”  This describes Donald Trump accurately.

Ignore The Court at Your Peril

Wikipedia also states, “Contempt of court is essentially seen as a form of disturbance that may impede the functioning of the court.  The judge may impose fines and/or jail time upon any person committing contempt of court.  The person is usually let out upon his or her agreement to fulfill the wishes of the court.”  In other words, Mr. Trump, you have never been, nor will you ever be above the law.

Trying To Stave Off the Inevitable Again…

“The Donald” was ordered back in February of this year to turn over documents for scrutiny no later than March 31, 2022.  It is unclear whether the daily fine is retroactive to the end of March deadline or not, but we can hope that it is.  Sources report that Trump’s legal team had agreed to provide the documents but then filed exceptions saying the summons, despite having been approved by the judge, “is grossly overbroad, unintelligible, unduly burdensome, and does not adequately describe which documents and communications are requested or sought with reasonable particularity.”  Letitia James, the New York State Attorney General, sought the fines to force the former president to comply with the NY State subpoena.

More Of the Same Game

Trump and his company, The Trump Organization  is accused, quite bluntly, by the state of NY of tax fraud.  The attorney general’s accusations in the filing are regarding misreporting property values to receive loans with better terms and improved tax positions.  New York’s top lawyer had also said of late her investigators had, “uncovered substantial evidence establishing numerous misrepresentations in Mr. Trump’s financial statements provided to banks, insurers, and the Internal Revenue Service.”

What, Me Cooperate?

Needless to say, “The Donald”, who apparently feels he is above the law, is still not cooperating.  Ms. James considers Justice Engoron’s actions to be “a major victory” and that the rule of law has prevailed.  These documents are needed for an attorney general investigation into Trump’s business holdings.  Her office has been assisting the Manhattan District Attorney’s office with a synchronous criminal investigation into Donald’s companies, as well.  The court, declaring him in contempt is monumental.  Mr. Trump apparently committed crimes, and this decision should hopefully knock his attitude down a few pegs, but I doubt it will.

More Ways to Try to Hold Off the Inescapable

Criminal charges against his “Organization” are being pursued, and it’s CFO Allen Weisselberg who denies wrongdoing and has entered a not guilty plea despite charges of falsification of business records and tax fraud.  The subpoena in the civil probe by New York’s lead litigator is similar, perhaps say, to the turning over of one’s tax returns when running for president.  Forty-five sued Attorney General James, filing in federal court, at the end of 2021, claiming her exploration to have political motivation.  The suit is still unresolved.  Gee, could this be a stall tactic on the part of “The Donald”?  He would never do such a thing, not.  Trump attorney Alina Habba claims he is unable to turn over the documentation, claiming that he does not actually have said documents.  She goes on to say the office of the attorney general was told this.

I Don’t Know Where It Is

Ms. James made it clear that Trump and the company were to provide statements regarding what they did to attempt finding these documents.  She went on to say Donald should have knowledge of the whereabouts of such documentation, since he, “personally executed documents central to the issues under investigation.”  If this is complied with, the civil contempt charge can potentially be averted. Well, how difficult is it to look in the paper shredder or the fireplace, Mr. Trump?  It could save you ten grand a day.  If you go too many days being fined this significant sum of money, how will Melania get her plastic surgery, or will you be able to afford golf balls, because those are the only kind you possess.  Ten big ones is a lot of McDonald’s, Donald.

Which Witch is Which?

Of course, forty-five’s lawyer is calling this, “a continuation of the greatest witch hunt of all time”; let her tell that line to Joan of Arc.  The Trump Organization alleges turning over more than 750,000 documents in this investigation, however the New York attorney general claims that the release of papers has been rather lethargic.  She wants a look at “post it notes” and the files that “The Donald” utilized as communication to his employee base.  This information is necessary to examine and evaluate whether civil suit will be brought against the former ‘Oval Office’ occupant and his firm.

Still Subject to The Rule of Law

Trump’s attorneys have filed an appeal and we don’t know whether the court of appeals will suspend the fine during the appellate process.  But reportedly the judge has just recently rejected “The Donald’s” affidavit, which claims Trump does not have the documents that are being demanded by the Attorney General of New York.  In closing, I for one am overjoyed to see any legal action against forty-five because absolutely no one is above the law, whether it be criminal or civil.  Statutes govern all citizens, even former White House residents.

OPINION:

Put the Mask Back On Rudy;  We Don’t Want to See Your Face

By Anna Hessel with Wes Hessel

“I’m Done”

When Trump attorney Rudy Giuliani, the former Mayor of New York City, was unmasked on “The Masked Singer”, judge Ken Jeong walked off the stage, saying, “I’m done”, and who can blame him?  Personally, I was surprised that even a FOX show would have a man with Rudy’s lack of morality on any episode.  Shock value for sure but not a wise decision; viewership is sure to tank, one can hope. Host Nick Cannon stated, “It surprises us all that you’re here”.  Exactly Nick, it’s mind boggling that he appears on any television show, other than perhaps, “America’s Most Wanted”.

Trial By Jury, Not By “Combat”

Of course, what we want to see is Mr. Giuliani and his former client “The Donald” on trial for crimes against our nation and humanity.  His “trial by combat”, “Game of Thrones” comment regarding the January 6th, 2021, insurrection, and his client’s part in it makes my blood run cold.  This man belongs behind bars, not behind a mask on any television show.  His barbaric comment, “I was referring to the kind of trial that took place for Tyrion in that very famous documentary about fictitious medieval England.  When Tyrion, who is a very small man, is accused of murder.  He didn’t commit murder, he can’t defend himself, and he hires a champion to defend him”, borders on the insane.  The only time we care to hear him sing would be in a court of law against the Trumpster and his fellow cronies.

Work Cut Out for Him

The Federal Prosecutor’s office for the Southern District of New York (i.e., Manhattan) has been pursuing cases regarding Rudy Giuliani and Donald Trump for some time.  As of October, of last year, it is headed by President Biden nominee Damian Williams, the first African American to hold the position.  We wish him Godspeed.

“…In Deep Trouble”

During an interview a year ago this month with Vanity Fair, Preet Bharara, the Southern District prosecutor from 2009 to 2017, was quoted as saying, “Rudy Giuliani is in deep trouble”, as he should be.   Later in the same interview, Bharara also quipped in response to the allegations of the Justice Department under Trump and ally Bill Barr blocking search warrants related at the time, “It’s possible the delay by Justice cost Rudy Giuliani a Trump pardon.”  A pardon by Trump was given to his former campaign chairman Paul Manafort, sentenced to seven years for his wrongdoings, as one of Trump’s last actions in office during December of 2020.

Bad Company Continues to Corrupt Morals

Giuliani’s apartment was searched to ascertain if he broke political lobbying laws when he served as Donald Trump’s lawyer.  Once the top Federal Prosecutor on the island of Manhattan himself, his law license was suspended for “false and misleading statements” in regard to Trump’s loss of the 2020 election in two boroughs of the city (both Manhattan and the Bronx) he once was mayor of.  He is also suspended from practicing law in Washington, DC. Rudy could face disbarment.  What a fall from grace his involvement with Forty-Five has caused him.  As the Bible says and is often echoed, “Do not be misled: ‘Bad company corrupts good character’” (1 Corinthians 15:33 NIV).

September 11th To January 6th?

Makes one ponder whether Rudy’s heart was ever in the right place. Clearly, the Giuliani of 9/11 is not the man that is partner in crime to the orange haired monster.  During those attacks on our nation, Giuliani was counted upon to make a phoenix rise from the ashes. He was the loving father our nation needed,  intelligent and strong.  He made a horrific situation almost bearable, doing his best against the worst nightmare our nation had faced.  He showed courage and fortitude. What has happened to the man we came to admire twenty-one years ago?   Many books have been written about the Manhattan College and NYU School of Law alumnus.

The Taller They Are…

I, for one, am saddened by his fall. It resembles a bad dream but, unfortunately, the nightmare is so very real.  It is disconcerting enough when one of Trump’s cronies is a criminal, but it is certainly all the more distressing when the person was once considered an American hero.  This reminds one of the O.J. Simpson trial.  Will Rudy’s trial be similar, “If it does not fit, you must acquit”?  How is the man we now distrust and detest, the same one we admired during one of the saddest and darkest times in recent history? It seems incomprehensible.

That Was Then, This Is Now

Rudy Giuliani handled the brutal attack on the World Trade Center with aplomb and strength, but now during our most recent hour of distress and vexation Mr. Giuliani has not only failed our nation, he supported the unthinkable acts of violence.  This brings up the same question regarding people we know personally who took a ride on “The Donald” train and lost their way (if they ever really knew it).  Is there any turning back for those afflicted with the Trump cancer?  In the case of Rudy Giuliani, it appears to be terminal.  He claims that he should not be held accountable for the Capitol riot, saying his “trial by combat“ comment was hyperbolic. Well, someone believed his words, Rudy, an insurrection certainly occurred.

Casualties Beyond That of Respect for Constitutional Practice

Four lives were lost immediately during the violence – two to “natural causes” of cardiovascular disease, one to meth overdose, and the defensive shooting of Ashli Babbitt.  Officer Brian Sicknick suffered two strokes, the second fatal, shortly thereafter as a result of the significant injuries he sustained that day. A fifteen year police veteran Howard Liebengood committed suicide three days after the travesty, followed by fellow Officer Jeffrey Smith a few days later.  One hundred and forty police officers were injured during the attack on our nation’s capital.

Since The Glove Does Fit, We Must Convict

Rudy Giuliani needs to stand trial for his role in the attempt to overthrow the 2020 election.  No one is above the law; not a former president, an associate Attorney General, or even Time Magazines “Person of the Year” for 2001. Twenty years after being named man of the year Rudy has turned to supporting violent overthrow of the government.  Rudy is no longer “America’s Mayor”, he is now part of America’s ongoing nightmare.  It is with a heavy heart that I have watched Donald Trump lead so people astray. I trust in God, not Mr. Trump or any of his cohorts.  In closing, I demand they investigate and if proven guilty, “Throw the book at this masked singer.”

I think it is time to remove the obstructionists from the Democratic Party

D. S. Mitchell

Joe’s Talking on Fox

12/19/2021. Joe Manchin (D.W.V.) is on FoxNews (sic) telling Bret Baier he “cannot vote” for the Build Back Better bill. Finally after months of dancing about, throwing up one road block after another Manchin, playing with the press and his colleagues has finally come clean and said it out loud. He, the lone Democrat,  was now going to squash the bill, that would have given assistance to 70% of his constituents.

Out of Touch

I am dumbfounded. How could this rich, fat, white, yacht sunning, coal mine owning, entitled man be so cruel, and corrupt? How can he shut his eyes to the basic needs of the most vulnerable people in his state? West Virginia is one of the poorest states in this country, it seems Joe wants to keep it that way. By standing against the BBB act Manchin is not only denying West Virginians food on the table, affordable prescriptions for life saving medicines, and dentures in their mouths, but every other person in the country. Without remorse, apparently.  Enraged, I switched to CNN where Jake Tapper was interviewing Bernie Sanders (I.Vt).

Unrestrained Passion

Bernie Sanders went after the failed senator from West Virginia with unrestrained passion. Bernie called Manchin a “coward” for not standing up to the lobbyists and special interest groups (which Manchin is part of). Bernie, is also a wealthy man, just like Joe Manchin. But, Bernie seems to have a deep well of human empathy, decency, and compassion, which apparently, Manchin cannot understand or emulate. Is Manchin capable of embarrassment?  Being the only Democratic senator that is willing to let kids go hungry, not only in West Virginia, but across the nation, should make him red faced with shame and embarrassment.

Purge the Party

It is time to purge the Democratic party of obstructionists, like Manchin, that are willing to stop a president and his policies by their single vote. Joe Manchin you were not elected president of the United States. Get in line and support President Biden and the Democratic platform. Support voting rights. If you are a Republican, Mr. Manchin, run as one, don’t pretend to be a Democrat. Be brave. Be courageous. As I see it Mr. Manchin, is intent on his legacy being nothing more than the dark smear left by a wet fart.

Quotes on Courage

Here’s a brief collection of some pretty smart comments by some pretty smart people on the topic of courage in life and politics.

1.) “Courage is what it takes to stand up and speak; courage is also what it takes to sit down and listen,” Winston Churchill

3.) “Courage conquers all things,”  Ovid

4.) “The strongest, most generous and proudest of all virtues is courage,” Michel De Montaigne

Conclusion

It is time to fight the obstructionists in the Democratic party. Joe Manchin cannot be allowed to stand in the way of progress much longer. He has ‘shown his ass.’ as they say in Texas, and a few other places; time for Mr. Manchin to vote with his party or leave the party.

OP-ED: The Dangers of the “Shadow Docket”

OP-ED: The Dangers of the “Shadow Docket”

The conservative court is using the shadow docket to hide their partisan decisions.

OP-ED:

The Dangers of the “Shadow Docket”

There is a fundamental danger to our democracy when the Supreme Court is allowed to hide their actions through the misuse of the “Shadow Docket.”

The “shadow docket” references cases taken up on an ’emergency basis’, outside the scope of the Supreme Court’s normal procedural order. . . .

By D. S. Mitchell

Partisan And Controversial Decisions

Observers have noted that the current court has disproportionately used the shadow docket to authorize its most right-wing and controversial decisions. Nearly all of the SCOTUS’s Covid-19 decisions have seeped and bubbled up from the shadow docket. Specifically, both of its rulings on the CDC eviction moratorium came through this dark and enigmatic process.

An Unsigned Opinion

In August of 2021, SCOTUS handed Biden a shocking ruling. The court ordered Biden to re-instate Trump’s “Remain in Mexico” program. Where did this ability suddenly manifest itself? The court has no authority over treaties with foreign governments. None. The outrageous ruling came in a single one paragraph unsigned opinion. This opinion (like other Shadow Docket opinions), gave no insight into the judicial history supporting the court’s decision to upend the constitutional separation of powers.  The court is now looking at the Texas abortion law. I’d call it a bit late. The heartbeat law went into effect on 9/1/2021. It is the first time a state has successfully imposed a six-week abortion ban since Roe v. Wade was decided.  The only reason is that the court has been packed with anti-abortionists. SCOTUS refused to take up the case, initially attempting to hide behind the shadow docket.

Vigilante’s Extraordinaire

As a refresher, SCROTUS said, (by initially refusing to hear the case) it was okay if Texas set up a system where vigilantes are allowed, and in fact, encouraged to pursue a woman in court for damages of up to $10,000; and anyone who assists her in obtaining an abortion.  Imagine this, it can be the cabbie that took the woman to the medical appointment, a friend who provided educational materials on termination, or the doctor who provides the abortion. Each of them under Texas law can be hauled into court and sued by someone with no standing in the case, in effect, on behalf of the state.

Dystonic Fiction

Atwood’s ‘The Handmaiden’s Tale’ in real life.

What We Expect

In the innocence of our collective minds, we fantasize the nine justices in their solemn black robes hearing robust debate in open court in front of fascinated and anticipatory spectators. Their esteemed heads taking in the well-considered arguments between opposing attorneys and ideologies, giving deliberate consideration to the legal issues of each individual case. Only after prolonged and august discussion does the court publish their venerable decisions in long verbose opinions. But, that is a faulty image of what is actually happening, folks. This heavily conservative court has slipped into a dangerous shadow zone, a place where justices lack the courage to sign their names to their own rulings, while expecting complete deference and compliance to those rulings. Somehow the two do not mesh in a democratic society.

Here’s How It Works

Here’s how it works in the SCROTUS of 2021. Lawyers are allowed to submit expedited briefs to make their “emergency” arguments, but they are not allowed to argue in person, in full view of the press and the public. These decisions don’t come after months of deliberation amongst the justices, but quickly and through whatever informal conversations the justices may have between themselves. Usually they don’t bother to explain to litigants the law or logic behind their decrees, instead issuing an order often amounting to a mere few sentences.

My Thoughts On The Matter

I believe, it is clearly evident that SCOTUS is operating in bad faith. This group of hacks is so lazy in their decisions that they won’t even take time to create legal reasons for their partisan hackery. Under the guise of “emergency” rulings this flawed and broken court is making policy. Courts do not make policy. That is not their role. Unsurprisingly the policy this court concocts melds nicely with the extremist Republican party’s political agenda. Using the “shadow docket” the court is attempting to camouflage it’s heinous actions.

Hitting The Talk Shows

Recently several of the sitting justices, hearing angry rumblings across the country have taken to the airwaves. Their recent appearances across media platforms make it clear that the justices have noted that the public view of the supreme court is at its lowest level in decades. When you have justices making speeches at colleges and going on TV claiming they “are not partisan hacks” you can damn well be assured they know the public is on to them.

The Real Danger

The power now wielded by unelected conservative justices is unnerving to me, and should be worrisome to anyone, no matter their place on the political spectrum. Just to point out, any Executive Order signed by this president (or any other president), any law passed by Congress, can be undone in the dark of night, without reason or explanation. Since this administration lacks the spine to proceed with court reform we can expect the six conservative judges to hold veto power over the Democrats entire political agenda.  Not just this year, or next, but for decades to come. It is time in the opinion of this writer to expand the court. The number of justices has been changed five or six times. Such action is not new, but it sure as hell looks like it is necessary.

Election Subversion & Suppression: dilution of voter’s Influence

By William Jones and D. S. Mitchell

Look to the Constitution

The U.S. Constitution defines who is eligible to vote. For example, you must be a U.S. citizen over 18 years of age to vote. Each person can vote only once in a given election. Pretty straight forward stuff.

To Clarify

Voter fraud means ineligible votes get counted (ex. husband votes for Trump using dead wife’s mail-in ballot.) Voter suppression refers to any effort to prevent eligible voters from being allowed to vote.(ex. politicians divide up congressional districts to benefit their own political party, diluting the opponents impact at the ballot box.) Any manipulation of the vote goes against the democratic ideal.

What’s Going On With Rudy?

What’s Going On With Rudy?

Rudy Continues His Nosedive

By William Jones and D. S. Mitchell

Confiscated

In recent years, the image of Rudy Giuliani has sunk to lows unimaginable  two decades ago.  His legacy has been severely damaged by his connection to Donald Trump.  In his pursuit of  Trump’s approval, and every cent he could get his hands on, Rudy may have broken the law while trying to help the former president overturn the 2020 election and line his own pockets.  The FBI thinks there is evidence of crimes and they just confiscated Rudy’s personal and business devices.

Rudy’s Bio

Rudolf Giuliani was born on May 28th, 1944, in Brooklyn, New York; U.S.A. He attended Manhattan College as well as New York University. For over 50 years, Rudy Giuliani has served, city, state and national government in multiple capacities. Giuliani has also had a private law practice.

Giuliani’s entry into politics

Giuliani is a long time Republican. In 1993 he was narrowly elected Mayor of New York City.  Giuliani immediately began cracking down hard on petty criminals. He always urged police to take aggressive stances against even minor violations of the law. Giuliani was often referred to as “the Nanny of New York.” He claimed credit for reduced crime rates stating that civilization had found its way into the city.  Critics disregarded Giuliani, stating crime rates had decreased nationwide.  They also added that Giuliani was contributing to police abuse and corruption. Rudy was expected to run for the U.S. Senate in 2000, but due to some negative personal events he decided not to run.

High Point Amidst Disaster

On September 11, 2001, New York was attacked. The attack brought down the twin towers of the World Trade Center leading to the death of over 2800 people. Giuliani received praise for his handling of the situation, and the aftermath. He even was knighted by Queen Elizabeth II for his conduct. In 2007 he announced that he would seek the Republican Party presidential nomination in 2008. However, in late January 2008, Giuliani withdrew from the race after finishing a distant third in Florida.

Tied To Donald Trump

Rudy Giuliani was an early enthusiastic supporter of  Donald Trump in his 2016 run for president. After Trump’s election, Giuliani jostled for several cabinet positions but was overlooked. He was later chosen as an ‘unofficial adviser on cyber security.’ In 2018 Giuliani was part of the legal team that represented President Donald Trump in the Special Counsel’s (Mueller) Investigation into Russian interference in the 2016 U.S. elections.  After the Special Counsel declined to file charges against the then-President Trump Giuliani continued as the president’s ‘personal attorney’.

Ukrainian Mischief

In search of “dirt” on Trump’s anticipated rival in the 20220 election, Joe Biden, Giuliani became  involved in what was referred to as a backchannel between President Donald Trump and some not so kosher former Ukrainian officials. The allegations indicate that Giuliani engaged in efforts meant to pressure current Ukraine officials into launching multiple investigations into corruption by Joe Biden’s son, Hunter Biden. The quid pro quo allegations and the firing of Ukrainian Ambassador Marie Yovanovich brought Trump and his associates, including Giuliani, under intense scrutiny.

The First Impeachment

An impeachment was launched by the House of Representatives against President Trump. Giuliani was portrayed as a key player in the scandal during the House proceedings. In December 2019, after being impeached, the door of hope opened for Trump in February 2020 when the Senate acquitted him. Time was not in his favor as Joe Biden defeated him by 7 million votes in November.

2020 Election Challenges

Following Trump’s defeat in the 2020 presidential election, Trump picked Giuliani to head his legal team  challenging the election results. Giuliani’s failure was notable, losing every case in every jurisdiction. The process was a total failure.

Giuliani’s Raided by the Feds

On Wednesday, April 28th, 2021, under the authority of a duly authorized search warrant Federal Agents raided Giuliani’s Manhattan home and office. Various gadgets were seized, including computers and cell phones.  It looks like the business dealings of Rudy Giuliani are under investigation. The Feds look serious. The FBI doesn’t execute search warrants on high profile individuals, especially lawyers, unless they are confident they will find incriminating evidence. Leaks indicate Giuliani may be under scrutiny for illegal money transfers, campaign finance fraud, and acting on the behalf of a foreign government, etc, etc, etc.  According to the prosecutors, the warrant, which required approval from the top levels of the judicial Department, and a federal judge, signifies that the government is convinced Giuliani has committed a federal crime(s).

Look Over There

Mr. Giuliani, in a statement after the seizure, denied any wrongdoing and argued that the search warrants demonstrated a “corrupt double standard” on the part of the Justice Department. Giuliani said he was being persecuted while the DOJ/FBI are ignoring  “blatant crimes” by Democrats, including Hillary Clinton and President Biden. He even stated the Feds refused to take evidence of crimes by Hunter Biden that Giuliani has in his possession.

Victoria Toensing
There was a third search warrant issued at the same time for the cell phone of  Washington lawyer Victoria Toensing.  Toensing is a former federal prosecutor and a close associate of Rudy Giuliani and former President Donald Trump. Her law firm issued a statement saying Toensing is not a target of the federal investigation.
The Evolving Situation
The full scope of the investigation is still  not clear.  On Thursday 29th April 2021, Donald Trump told Fox business that Giuliani was “the greatest mayor in the history of New York and a great patriot”. The White House press secretary said on CNN that the White House was given no heads up about the raid prior to its execution.
Orange Jumpsuits

Many of Trump’s allies have been trapped in federal investigations, and there are likely to be more on the horizon.  The big question becomes will Giuliani pull a Michael Cohen and ensnare the former president in criminal charges. Time will tell. Of course, these guys are all as old as dirt. Any could drop dead at any moment. Hopefully the AG gets them sentenced first.

Liz Cheney: Speaking To History Not Re-Election

Liz Takes a Stand as Republicans Move to Force Her Out

By D. S. Mitchell

Deep Trouble

Elizabeth Lynne Cheney 7/28/66 is an American attorney and Republican politician.  Liz Cheney is the House Republican Conference chair, the third-highest position in the House Republican leadership.  Cheney is the daughter of former Vice-President Dick Cheney. She is the sole (at-large) Representative from Wyoming and she is in serious political trouble.

Trump For Elise Stefanik

Cheney serves on two powerful House committees, the Armed Services Committee and Natural Resources. It is believed Ms. Cheney will be removed as the 3rd ranking Republican  sometime within the next week when the House reconvenes. Donald Trump has come out against Cheney and has thrown his support behind New York Representative Elise Stefanik. Since Trump’s announced support, both Minority Leader, Kevin McCarthy (CA) and Minority Whip Steve Scalise (LA) have come out to publicly support the Stefanik for Cheney swap.

Naughty Girl
McCarthy claims the reason Cheney is losing her leadership role is because, “she isn’t the best policy messenger for the party. ” I see it as strange, considering Cheney is one of the most consistent conservative voices on everything. In fact, she has voted more with Trump than Stefanik has, by nearly 20% of the time. What is going on here is that Liz  has a conscience and she is willing and seemingly eager to speak out against former President Donald J. Trump. And of course there was her vote to impeach Trump over his part in the capitol riot on January 6, 2021.
Rising Star
The move to replace Cheney is proof that Stefanik, who was elected to a fourth term from New York state, has seen an ascendancy in her career since she began her ardent public defense of Trump.  Sources say that Trump first noticed Stefanik during her interrogation of witnesses during the House Intelligence Committee hearings on the alleged Ukraine quid pro quo. That performance gave Stefanik a place in Trump’s PR efforts during the Senate trial. In February 2020 Trump praised Stefanik in a speech celebrating his acquittal in the Senate, “she looks good, she looks like good talent.”
The Message
Stefanik opposed the second impeachment of Trump earlier this year for his role in the January 6 insurrection.  She claimed the House action was a “partisan ploy with no basis in the Constitution.. ..The Democrats’ decision to impeach the President with one week remaining in his term further fuels the divisions in the country during this very trying time.” Total B.S. I say.
McCarthy Kisses Trump Ring
Trump and McCarthy are keeping in regular contact over the Cheney issue.  “They’ve definitely spoken recently” said Trump aide Jason Miller. Master puppeteer has McCarthy and Scalise singing his song. The Heritage Group confirmed Cheney’s lifetime vote score is 80%. Stefanik’s is 48%. And even when it comes to votes in support of Trump  Cheney voted 92.9% of the time while Stefanik backed him 77.7% of the time.
GOP Faces Divide Over Trump’s Big Lie
This battle has nothing to do with conservatism. Or, according to the data, about supporting Trump’s agenda while in office. Sadly, Scalise, McCarthy, Stefanik and others have higher ambitions. Each hoping to rise in a GOP that is controlled by former President Trump despite his two impeachments, lawless abuse of power, alleged sexual assaults, failed re-election bid, false claims of voter fraud,  failure to effectively handle the pandemic, with more than 441,000 deaths during his tenure in office.  I’m sure a lot of GOP politicians wish the Orange One would just go quietly into retirement, but why should he, the Republicans keep feeding him red meat, and kissing the ring.
 They  Spoke Up Once
Kevin McCarthy, Liz Cheney, and Mitch McConnell have each harshly criticized Trump’s role in the capitol insurrection. McConnell and McCarthy made the bet that criticizing Trump’s reaction to the insurrection once would allow them a quick return to the Trump umbrella in a party that still embraces Trump. But Liz Cheney, Adam Kinzinger, and Mitt Romney all  said, “hell no,” and drew a line in the sand over the 1/6/2021 riot at the U.S. Capitol, as well as the run up to that day and its aftermath, all centered on Trump claiming, despite all evidence, that the 2020 election was “stolen”.
Ideology

The once holy Republican foundational creed has been thrown overboard as the Republicans have moved to a cult of personality around Donald Trump. The version of the GOP that Romney, Kinzinger, and Cheney embraced  no longer exists. The Republicans have replaced the old party with a Trump dominated party focused on populist, autocratic, anti-free trade, and deficit blind budgets. Trump appears to be the Republican favorite for the 2024 presidential nomination.  Hopefully, the country has had enough of Donald J. Trump. If we haven’t had enough we need to prepare ourselves for a totalitarian future if  Trump’s increasingly radical authoritarian behavior is sent back to the White House.

A Lonely Defense

Liz Cheney has been on a lonely defense of the truth, (1.)last year’s election was not stolen, (2) that Donald Trump incited a riot at the Capitol in an effort to overthrow the 2020 election, (3) a bipartisan commission should be convened to understand the insurrection, (4) continuing the big lie is an ongoing threat to democracy.  In a 5/6/2021 Washington Post Op-Ed Liz Cheney made the case that the GOP may be irrevocably harming itself in the eyes of Americans by ignoring Trump’s offenses against the basic democratic principles that underpin the country. She made it clear that the GOP is “at a turning point.” The party must choose truth and fidelity to the Constitution, or blind fidelity to the Trump scam.

The Future?

The message is clear, Liz Cheney is about to be voted out of her leadership position, Mitt Romney the Republican presidential candidate in 2012 was booed at a recent GOP function, and Adam Kinzinger is being primaried.  Donald Trump will continue as a driving force in the Republican Party for an unknown period of time. Traditional conservatives like Liz Cheney, Mitt Romney, and Adam Kinzinger’s are defending a vision of the Republican Party that is gone, if it ever did exist.  These few crusaders have put principle over personal loyalty to an ex-president, but I personally think they will be left to wander in the wilderness until Donald Trump’s hold on the party is broken.
